Brain Damage Detected in NFL Players

A new imaging technique has allowed the detection of protein abnormalities in the concussed brains of living retired football players that are identical to the autopsy findings of chronic traumatic encephalopathy (CTE) in deceased athletes, researchers reported.

Positron emission tomography (PET) scanning using a tracer for tau protein known as FDDNP found significantly higher binding values among retired players than in controls in several regions of the brain, including the amygdala and caudate, according to Dr. Gary Small of the University of California Los Angeles and colleagues.

In addition, the tau binding values were highest in the players who had experienced the most concussions during their careers, which "suggests a link between the players' history of head injury and FDDNP binding," the researchers wrote in the February American Journal of Geriatric Psychiatry.

"If this research continues in the direction we expect, it would have a big impact on the early detection of this condition, helping us to develop interventions that could delay the onset of symptoms," Small told MedPage Today.

But it will be important to replicate these findings in larger studies, experts cautioned.

"If indeed it is sensitive and specific enough for tau, it would be extremely exciting and hugely important, but this was only five players," said Dr. Robert Cantu of Emerson Hospital in Concord, Mass., and co-director of Boston University's Center for the Study of Traumatic Encephalopathy.

The list of athletes who experience multiple concussions during routine play and then develop cognitive, behavioral, and mood disturbances, which in some cases lead to suicide, continues to grow, and some 4,000 former National Football League players are suing the league, claiming that the risks of repetitive head injury were long downplayed.

Autopsy findings in players who died have included deposits of phosphorylated tau in neurofibrillary tangles, as well as diffuse injury to axons and abnormalities of white matter.

Despite the increasingly widespread recognition that players with multiple concussions are experiencing severe consequences, research into the resulting condition has been hindered by the fact that no diagnostic test has been available that could identify changes before death.

Small and his colleagues developed the tau tracer FDDNP with the goal of detecting the presence of tau tangles and amyloid plaque in the living brains of Alzheimer's disease patients.

They found that with this PET technique they could differentiate Alzheimer's patients from those with milder forms of cognitive impairment or normal changes of aging.

In the current study, they performed neuropsychiatric evaluations of five former players who exhibited mood or cognitive symptoms clinically, and then used PET scanning with FDDNP to examine their brains.

The players had played various positions, including quarterback, center, and defensive lineman, with careers ranging from 10 to 16 years.

The researchers also assessed five controls who were matched for age, body mass index, family history of dementia, and educational attainment.

Frequent multitaskers are bad at it: Can't talk and drive well

Jan. 23, 2013 ? Most people believe they can multitask effectively, but a University of Utah study indicates that people who multitask the most -- including talking on a cell phone while driving -- are least capable of doing so.

"What is alarming is that people who talk on cells phones while driving tend to be the people least able to multitask well," says psychology Professor David Sanbonmatsu, a senior author of the study. "Our data suggest the people talking on cell phones while driving are people who probably shouldn't. We showed that people who multitask the most are those who appear to be the least capable of multitasking effectively."

The new study was scheduled for publication Jan. 23 in PLOS ONE, an online journal of the Public Library of Science.

The other senior author, University of Utah psychology Professor David Strayer, adds, "The people who are most likely to multitask harbor the illusion they are better than average at it, when in fact they are no better than average and often worse."

Citing humorist Garrison Keillor's catchphrase about kids in Keillor's fictitious hometown, Strayer says people who use cell phones while driving "all think they live in Lake Wobegon, where everybody is above average. But it's a statistical impossibility."

The study ran 310 undergraduate psychology students through a battery of tests and questionnaires to measure actual multitasking ability, perceived multitasking ability, cell phone use while driving, use of a wide array of electronic media, and personality traits such as impulsivity and sensation-seeking.

The key findings:

  • "The persons who are most capable of multitasking effectively are not the persons who are most likely to engage in multiple tasks simultaneously." Instead, people who score high on a test of actual multitasking ability tend not to multitask because they are better able to focus attention on the task at hand.
  • The more people multitask by talking on cell phones while driving or by using multiple media at once, the more they lack the actual ability to multitask, and their perceived multitasking ability "was found to be significantly inflated." In fact, 70 percent of participants thought they were above average at multitasking, which is statistically impossible.
  • People with high levels of impulsivity and sensation-seeking reported more multitasking. However, there was an exception: People who talk on cell phones while driving tend not to be impulsive, indicating that cell phone use is a deliberate choice.
  • The research suggests that people who engage in multitasking often do so not because they have the ability, but "because they are less able to block out distractions and focus on a singular task."

The researchers conclude, "The negative relation between cellular communication while driving and multitasking ability appears to further bolster arguments for legislation limiting the use of cell phones while operating a motor vehicle."

Sanbonmatsu and Strayer conducted the study with University of Utah co-authors Jason Watson, an associate professor of psychology, and Nathan Medeiros-Ward, a doctoral student in psychology. The study was funded by the American Automobile Association Foundation for Traffic Safety.

How the Study Was Performed

The researchers say that while people frequently multitask to try to achieve several goals at once, "relatively little is known about when and why people perform more than one attention-demanding task at a time. Related to this, little is known about who is most likely to multitask."

The study participants were 310 University of Utah psychology undergraduates -- 176 female and 134 male with a median age of 21 -- who volunteered for their department's subject pool in exchange for extra course credit.

To measure actual multitasking ability, participants performed a test named Operation Span, or OSPAN. The test involves two tasks: memorization and math computation. Participants must remember two to seven letters, each separated by a math equation that they must identify as true or false. A simple example of a question: "is 2+4=6?, g, is 3-2=2?, a, is 4x3=12." Answer: true, g, false, a, true.

Participants also ranked their perceptions of their own multitasking ability by giving themselves a score ranging from zero to 100, with 50 percent meaning average.

Study subjects reported how often they used a cell phone while driving, and what percentage of the time they are on the phone while driving. They also completed a survey of how often and for how many hours they use which media, including printed material, television and video, computer video, music, nonmusic audio, video games, phone, instant and text messaging, e-mail, the Web and other computer software such as word processing. The results were used to compute an index of media multitasking.

They also completed well-established questionnaires that measure impulsivity and sensation-seeking.

Who Multitasks and Why?

The researchers looked for significant correlations among results of the various tests and questionnaires.

"The people who multitask the most tend to be impulsive, sensation-seeking, overconfident of their multitasking abilities, and they tend to be less capable of multitasking," says Strayer, summarizing the findings.

The 25 percent of the people who performed best on the OSPAN test of multitasking ability "are the people who are least likely to multitask and are most likely to do one thing at a time," Sanbonmatsu says.

In contrast, 70 percent of participants said they were above-average at multitasking, and they were more likely to multitask.

"One of the main reasons people multitask is because they think they are good at it," Sanbonmatsu says. "But our study suggests people rarely are as good at multitasking as they think they are."

Multitasking ability on the OSPAN was significantly and negatively correlated with actual media multitasking and cell phone use while driving, meaning the people who multitask the most have the least ability to do so.

"If you have people who are multitasking a lot, you might come to the conclusion they are good at multitasking," Strayer says. "In fact, the more likely they are to do it, the more likely they are to be bad at it."

Sanbonmatsu adds: "Our data show people multitask because they have difficulty focusing on one task at a time. They get drawn into secondary tasks. ? They get bored and want that stimulation of talking while they are driving."

Study participants reported spending 13 percent of their driving time talking on a cell phone, which Strayer says roughly squares with federal estimates that one in 10 drivers are on the phone at any given time.

Media multitasking -- except cell phone use while driving -- correlated significantly with impulsivity, particularly the inability to concentrate and acting without thinking. Impulsive people tend to be more reward-oriented and more apt to take risks, so they may be less sensitive to the costs of multitasking, the researchers say.

Multitasking, including cell phone use while driving, correlated significantly with sensation-seeking, indicating some people multitask because it is more stimulating, interesting and challenging, and less boring -- even if it may hurt their overall performance.

The onetime voice of Charlie Brown in the animated "Peanuts" TV series was arrested on Sunday on five felony charges, NBC News confirms.

Peter Robbins has been charged with four felony counts of making a threat to cause death or great bodily injury, and a single felony count of stalking. After being booked in San Diego just after 3:30 a.m. local time on Monday, he was held on $550,000 bail. He is scheduled for arraignment on Wednesday.

The San Diego Union-Tribune reported that Robbins was arrested on Sunday evening as he crossed into the United States from Mexico at the San Ysidro Port of Entry. He was alone in his 2006 Mercedes-Benz C230 when a border officer pulled him aside for an examination. During that check, the officers learned he was wanted by the San Diego Sheriff's Department on a felony warrant for crimes against a person, said a U.S. Customs and Border Protection representative.

During an interview at San Diego's Comic-Con, Robbins, 56, said he'd begun as the original voice of Charlie Brown when he was 9 (video below). He voiced several "Peanuts" TV specials and films, including "A Charlie Brown Christmas," "It's the Great Pumpkin, Charlie Brown" and "A Boy Named Charlie Brown." When he reached 14, "it was time to move on," he said in that interview. His acting career also included roles on shows like "My Three Sons" and "F Troop."

Robbins' manager told the Union-Tribune that she was unable to discuss his arrest at the time, but planned to comment later Wednesday.

REDMOND, Wash.--(BUSINESS WIRE)-- Nintendo President Satoru Iwata unleashed Wii U news in an installment of Nintendo Direct today as he outlined Nintendo's future plans for the console. Iwata revealed how the Wii U launch lineup will be bolstered by a long list of top game franchises headed for the new console. These are games that longtime players and newcomers alike will love to play, and everyone will be experiencing them in new ways, thanks to the integrated second-screen experiences enabled by the Wii U GamePad controller. Iwata also detailed a number of enhancements designed to make the Wii U game experience more social, even if people are not playing in the same room.

"The fun of video games is not only just playing games, but also sharing experiences together with people ? even though they live far away, their skill levels are different or their experience does not happen at the same time," Iwata said. "We want Wii U to be the system that brings everyone together."

Game News

Two Zelda Games: Eiji Aonuma, the producer of The Legend of Zelda series, revealed two entries in the series for Wii U.
Super Mario is on His Way: The Nintendo EAD Tokyo Software Development team that created the Super Mario Galaxy games for Wii and Super Mario 3D Land for Nintendo 3DS is working on a new 3D Mario action game for Wii U. The game is scheduled to be playable at this year's E3.
Buckle Up!: Nintendo is also working on a new installment of the hit Mario Kart franchise. This game is also planned to be playable at E3.
Yarn Yoshi: The team that created Kirby's Epic Yarn is hard at work on the first console game to feature Yoshi as the main character since 1998's Yoshi's Story for Nintendo 64. Takashi Tezuka, director of Yoshi's Island and Yoshi's Story, is supervising the development of the new game, which is set in a fanciful world of yarn and textiles.
Wii Fit U Communities: New features coming to Wii Fit U include letting players create user communities on Miiverse from within the game. Community members can discuss exercises, BMI or weight changes and other health topics with other players as a way to encourage one another to reach their fitness goals. Similar functionality for other games is also planned.
Pikmin 3 Photos: The upcoming Pikmin 3 game includes a feature that lets players use the Wii U GamePad as a camera to share the same perspective as Pikmin and take close-up pictures of landscapes and creatures in the game and share them in Miiverse.
The Party Continues: A new installment in the Wii Party franchise is planned to launch this summer. The game features various play styles, including one that lets both players compete head-to-head using just the GamePad.
RPG Mashup: Nintendo has begun many collaborations with outside development partners to bring the best franchises and experiences to Wii U. In one such partnership, Nintendo and Atlus are working on a collaboration that features the Fire Emblem and Shin Megami Tensei franchises. A New Game from Monolith Soft: Tetsuya Takahashi and the team at Monolith Soft that worked on Xenoblade for Wii are working on a new game. A video trailer for the game was shown in the Nintendo Direct.
More on the Way: Iwata shared a new trailer for The Wonderful 101. That game and GAME & WARIO are scheduled to launch in the first half of 2013. Iwata also showed a new video for Bayonetta 2. That game and the new Super Smash Bros. installment are still on the way, but will need more development time before details can be revealed.

Virtual Console

Virtual Console for Wii U: A spring system update will add Virtual Console software to the Nintendo eShop for Wii U. The service will launch right after the spring update and will include a selection of NES and Super NES games, with Game Boy Advance games to be added in the future. The prices for NES and Super NES Virtual Console games for Wii U will be the same as they were for the Virtual Console on Wii. People who have already purchased the Wii version of a certain NES or Super NES Virtual Console game and transferred it to their Wii U console can buy the enhanced Wii U version of the same game for the reduced price of $1 for NES games and $1.50 for Super NES games.
Classic Games for 30 Cents! To celebrate the 30th anniversary of the release of the Famicom in Japan (which was known as the NES in the United States), Nintendo is making one NES or Super NES game available each month now through July at the anniversary price of just 30 cents. Each game will be available at that price for 30 days, and the first is the NES game Balloon Fight, which is now available in the Nintendo eShop for Wii U.

Social and System Enhancements

Miiverse Expands to Smartphones: Starting this spring, people will be able to browse Miiverse from their smartphones. Initially the experience will be browser-based, but Nintendo plans to create a dedicated Miiverse app in the future.
System Updates: Two major updates are on the way, one in the spring and one in the summer. The updates will introduce a wide range of functionality, such as Virtual Console capabilities and shortening the time it takes users to launch software or return to the menu screen.

Eleven Lamar CISD artists will have their works shown at the 2013 Houston Livestock Show and Rodeo Art Show, with six being eligible for the Rodeo Art Show Auction.

The students? works were judged as part of the Lamar CISD Student Art Exhibit. The Lamar CISD Student Art Exhibit will be on display Wednesday through Friday at the Fort Bend County Rosenberg Annex, 4520 Reading Road.

Artwork from across the District will be on display from 9 a.m. to 5 p.m. on those three days.

For the fourth year, Foster High School?s Christy Beltz won Best of Show at the Lamar CISD Art Show. The senior was the Grand Champion at the Rodeo in her freshman year and has since been ineligible for the auction. This year?s work is a painting, ?The Essence of Yellowstone.?

Foster senior Rachael Faye Becker earned a Gold Medal with her mixed medium piece, ?Peek a ?Boot.?

Alessandra Jara, a freshman at George Ranch High earned a Gold Medal with her colored drawing, ?Rank and Rowdy.?

Foster High senior Diem Tran won Special Merit for his mixed medium work, ?Miss Muffet.?

Lamar Consolidated High School senior Alejandro Escamilla won Special Merit for his Monochromatic Drawing, ?Holster.?

Emma Gaas, a junior at Foster, won Special Merit with her colored drawing, ?Girl?s Best Friend.?

Cindy Chen, a senior at George Ranch, earned Special Merit with her colored drawing, ?After the Ride.?

Daniel Pahutan, a 7th-grader at Reading Junior High won Junior High Best of Show with ?Cut from the Same Cloth.? Briscoe Junior High 8th-grader Chloe Marcheli earned the Gold Medal with ?After A Long Ride.?

Evan Matheson, a 5th-grade student at Hubenak Elementary was Elementary Best of Show with ?Spice it Up,? and Velasquez Elementary 2nd-grade student Jane Miller earned the Gold Medal with ?Mutton Busting.?

All these students will have their works on display during the Houston Livestock Show and Rodeo. The high school students will have their work judged during the Rodeo, with the possibility of making the auction.

Beltz is not eligible for the auction because she was Grand Champion during her freshman year. Her work brought a record $190,000 at auction.

Jennifer Stavinoha is the art teacher for all the Foster students; Jennifer Light is the art teacher for the George Ranch students; Saundra Hill is the art teacher at Lamar Consolidated; Monica Arratia is the art teacher at Reading Junior High; Audrey Feuge is the art teacher at Briscoe Junior High; Kimberly Vogt is the art teacher at Hubenak Elementary; and James White is the art teacher at Velasquez Elementary School.

Hubble focuses on the 'Great Attractor'

Jan. 22, 2013 ? A busy patch of space has been captured in an image from the NASA/ESA Hubble Space Telescope. Scattered with many nearby stars, the field also has numerous galaxies in the background.

Located on the border of Triangulum Australe (The Southern Triangle) and Norma (The Carpenter's Square), this field covers part of the Norma Cluster (Abell 3627) as well as a dense area of our own galaxy, the Milky Way.

The Norma Cluster is the closest massive galaxy cluster to the Milky Way, and lies about 220 million light-years away. The enormous mass concentrated here, and the consequent gravitational attraction, mean that this region of space is known to astronomers as the Great Attractor, and it dominates our region of the Universe.

The largest galaxy visible in this image is ESO 137-002, a spiral galaxy seen edge on. In this image from Hubble, we see large regions of dust across the galaxy's bulge. What we do not see here is the tail of glowing X-rays that has been observed extending out of the galaxy -- but which is invisible to an optical telescope like Hubble.

Observing the Great Attractor is difficult at optical wavelengths. The plane of the Milky Way -- responsible for the numerous bright stars in this image -- both outshines (with stars) and obscures (with dust) many of the objects behind it. There are some tricks for seeing through this -- infrared or radio observations, for instance -- but the region behind the center of the Milky Way, where the dust is thickest, remains an almost complete mystery to astronomers.

Amazon Woos Advertisers with What It Knows about - Technology ...

Google built its $38 billion business selling ads based on how people search and browse the Web. Facebook, too, uses what it knows about its one billion users to sell targeted ads. But when it comes to what many advertisers value most?what people actually buy, or what they may want to buy soon?there may be no better data than the information in Amazon?s 152 million customer accounts.

Since last year, the world?s largest online retailer has been packaging information on what it knows about consumers so that some marketers can use it to make split-second decisions about where to buy ads online and how much to pay for them. This automated process occurs on real-time ad exchanges that sell ad impressions as a person loads a Web page.

When this process began, Amazon used third-party technology, and its experiments were limited. Now it has developed an in-house platform for targeting ads to people who have visited and then left Amazon?s sites, making it likely that the company will open up these advertising services more widely over the next year.

?Today, if you?re browsing the Web, you might see an Amazon advertisement based on Amazon?s data. Tomorrow, you may see an ad from Coca-Cola based on Amazon data, and it?ll run through the Amazon platform,? says Jeff Green, CEO of the Trade Desk, which helps guide spending decisions by ad agencies.

Amazon did not respond to a request for comment about its advertising business, and the company does not break out its advertising revenue. But it?s clear that compared to Google and Facebook, advertising has been a relatively small and low-key business for Amazon. It brought in about $500 million of Amazon?s $48 billion in revenue in 2011, Baird & Co. senior research analyst Colin Sebastian estimates. Mostly this came from selling ads on its own websites.

But Amazon could soon generate much more than that with an advertising network that reaches onto many other sites.

For years, Amazon has put algorithms to work in order to recommend products to people who are on its sites. Now other companies are eager to find out exactly how Amazon?s knowledge about consumers can help them find the best audiences for their ads, says Kip Voytek, digital innovation director at the advertising firm MDC Partners.

Amazon would be unlikely to directly give advertisers access to its trove of information about individuals? browsing, purchasing, and product review histories, both because of its privacy policies and a desire to keep its valuable data proprietary. Instead, Amazon would create target audiences, such as people who recently purchased digital cameras. A marketer selling digital camera accessories could then use Amazon?s technology to bid for the ability to show ads to a person in that category.

Green points out that while Google might have more overall data about consumers,?Amazon?s data could be more valuable for advertisers. Amazon has ?a pretty clear understanding of the things I buy. They?ve learned a lot about me. Every time I?m convinced I have another medical ailment, I go to Google. But Amazon, what they have is really about my purchase intent,? he says.

Using its data to expand its advertising business could open up new fronts of competition with Google, which also owns a real-time bidding exchange and an ad-delivery network. But Amazon might be mainly interested in using its ad technology to help the retailers that sell products on its sites and through its Kindle tablets and e-readers. Voytek put it this way: ?The question that is open: is this Amazon competing with Google or is this Amazon competing with Walmart??

Food Review: Noodles & Company | The East Carolinian

I?m not sure about you, but I get antsy over long breaks from school. While I love my family and hometown, after about three weeks, Greenville begins looking better and better. This Christmas break was no different from the rest ? and on Jan. 3 my silver Honda civic began the familiar trip with Greenville marked as its destination.

One of my first meals back was at a pasta place that had opened just the week before. Noodles & Company quickly won me over, and just a few days ago a friend and I made a return trip to the restaurant, which is located on Evans St.

It was a grey and rainy day outside, but as we made our way into the restaurant the bright lighting immediately set the mood for what was to be anything but another dreary meal.

After we rounded the corner of the entryway, we walked to the counter and began perusing the menu board above the cashier station. While I was deciding on what I wanted to eat, I began to notice just how clean the entire restaurant was.

The kitchen, which was visible to the entire restaurant, was composed of the cleanest stainless-steel counters that I have ever seen in a restaurant. The open, clean kitchen spoke highly of the level of work the staff puts into keeping the place presentable.

I ended up choosing their most popular dish, the Penne Rosa with grilled chicken, along with the Tomato Basil Bisque soup. My friend chose the Pesto Cavatappi with a Ceasar Salad.

While the mounds of pasta and rich soup were the highlight of the lunch, the next best part came right after we ordered. Yes, I?m talking about paying. My bill, which included a regular size Penne Rosa with grilled chicken added, soup and a drink, came out to be only $11.20.

After I handed over my debit card with glee, I approached the most high tech drink machine I have ever seen. The coke machine was touch screen and offered more selections of fountain sodas and lemonades than I even knew existed.

Within five minutes of sitting down, our food was ready and brought out to us. While admiring the gorgeous plate that sat before me, I realized just how much food my $11.20 had bought. The pasta, which covered the plate, was almost spilling over the edges, and then on top of the mountain of pasta was an entire chicken breast. And the soup, which was only a dollar, was in a bowl big enough to have been a meal by itself. Needless to say, I finished off both of the dishes.

The pasta dish was composed of penne noodles in a creamy, somewhat spicy, tomato based sauce. My favorite part of the dish was the contrast between the salty feta cheese and the soft penne noodles, which were lightly covered with the rich and tangy sauce. I also enjoyed the vegetables that were included in the dish. The tomatoes, spinach and mushrooms were some of the freshest ingredients that I?ve ever tasted in a pasta dish. And, instead of the sauce overwhelming them, the taste of the vegetables stood out.

The Tomato Basil Bisque soup was completely different than your normal tomato soup. The consistency was thick and creamy, and the basil worked great to give the dish flavor. My favorite part of the soup, though, was the fact that it had a rich, cheesy taste. It was almost as if they had added milk and possibly cheese to thicken the soup, while simultaneously giving it the creamy, rich taste.

I also tasted my friends Cavatappi, which was light and would make for a great choice for someone eating healthy.

All-in-all, this restaurant?s amazing food and the Panera-meets-Starbucks atmosphere made for an enjoyable meal and experience. This modern caf? style restaurant, which combines the cheap prices and speed of fast food with the service and high quality dishes of a five-star restaurant, is a great addition to Greenville?s restaurant scene for anyone looking.

Labor attorneys share tips on intricacies of government contracting

With the state budget deficit a higher priority than an off-year bonding bill and more transportation projects, private contractors might be wondering about their chances of gaining work with public entities this year.

The good news, according to attorneys who work in that sector, is that the work is out there if you don?t mind hunting for it. Gaining work with city, county and state agencies can be lucrative and rewarding, but there are some issues to consider.

For one thing, keep in mind that each of Minnesota?s 853 cities and 87 counties has its own way of operating, said Robert J. Alfton, a labor and employment lawyer with Cummins & Cummins in Minneapolis.

?You can?t assume that the city of Bemidji operates the same as Minneapolis,? said Alfton, a former city attorney for the city of Minneapolis. ?They?re different in their legal structure ? some are statutory cities, some are charter cities.?

Fortunately, most cities and counties document and publish their various structures, regulations and mandates on their websites, giving business owners little excuse for not knowing what?s expected from them.

St. Louis Park attorney Gregg Corwin agreed, adding that the leadership of public entities can differ widely: A city might operate under a weak-mayor system in which department heads wield relatively greater power.

?You can?t look at government entities as a monolith,? said Corwin. ?They?re made up of individuals. You might find that dealing with a building official in one city is completely different from dealing with someone in the same position from a city 50 miles away. Get to know the individual.?

Part of that getting-to-know-you process means becoming a regular presence at council and board meetings as well as keeping your eyes open for events that may help to get your name in front of the right players.

According to Marylee Abrams of Abrams & Schmidt in Arden Hills, both the League of Minnesota Cities and the Association of Minnesota Counties have annual conferences where business owners can rent booth space.

Diversity is key

From a legal standpoint, some ongoing issues need to be watched by businesses that want to gain public-entity work, one of which is diversity ? not just in the bidding and hiring process but also in the makeup of business ownership.

A number of public agencies have adopted programs to advance the hiring of minority- and women-owned businesses, according to Brendan Cummins, also with Cummins & Cummins.

?Public agencies have a strong interest in expanding the sphere of who they?re doing business with, and that often includes small businesses,? said Cummins.

He pointed to the example of Minneapolis, which passed an ordinance favoring small and under-utilized businesses. Chapter 423 of the city code, better known as the Small and Underutilized Business Program (SUBP), establishes goals for hiring women- and minority-owned small businesses.

?The goal, as they see it, is to level the playing field in contracting,? said Cummins. ?You see this kind of public policy being carried out in public contracting in a number of locations.

?A lot of contractors might think it?s just about the low bid, but there are a lot of public policy goals, particularly involving diversity, that public entities are pushing.?

That viewpoint is similar at the state level, although rules of construction contracting place a greater emphasis on the makeup of a company?s work force than on owner status. The state Department of Human Rights has set its work force goals ? not mandates ? for state-funded construction projects minorities in Hennepin and Ramsey Counties at 32 percent minorities and 6 percent women.

?This requires a substantial reworking of the business model a lot of contractors have used,? said Cummins. ?Businesses have had to look at who they?re hiring.?

?Have the facts ready about your minority and women employees in case the subject comes up, because it probably will come up,? said Alfton.

Keep an eye on the Capitol

Another legal issue is that union membership among public employees is many times what it is in the private sector ? 37 percent in the former as opposed to about 7 percent in the latter, according to figures from the federal Bureau of Labor Statistics.

?You?ll need to keep that in mind as you bid,? said Alfton. ?It can affect everything about the project, starting with the budget.?

Finally, attorneys recommend keeping a close eye on the Legislature. The jury is out on bonding, and will likely stay that way. But even absent a nine-digit bonding measure like we saw last year, that doesn?t mean state-funded projects won?t be approved piecemeal.

?Stability in state funding is a big issue for our public-sector clients ? there are a lot of cities that get local government aid,? said Abrams. ?And I see transportation being a big topic this session ? finding ways to pay for a lot of transportation projects that have been sitting on the books for a long time.?

Suspect in Taft Union High shooting charged as adult

The suspect in last week?s shooting at Taft Union High School is being charged as an adult, District Attorney Lisa Green said at a Monday morning news conference.

Suspect Bryan Oliver, 16, is charged with two counts of attempted murder and two counts of assault with a firearm in the wounding of one student and the targeting of another, and one count of assault with a firearm in the wounding of teacher Ryan Heber, the district attorney said.

?Every shooting at a school is difficult,? Green said of prosecutors? work. She said the case was approached like any other high-profile case, and she is comfortable with prosecutors? decision.

While sheriff?s deputies continue gathering evidence, Green said, ?We feel we have been given a very thorough briefing.?

By law, a case had to be filed by 9 a.m. Monday. The suspect remains in juvenile hall after authorities said he showed up late to his first-period science class Thursday and opened fire with a shotgun, critically wounding Bowe Cleveland, 16. Cleveland was airlifted to Kern Medical Center and underwent surgery last week for wounds to his abdomen and chest.

Authorities said the second attempted murder count was related to classmate Jacob Nichols. Witnesses told police and reporters after the shooting Thursday that Oliver asked about Nichols? whereabouts as he waved his shotgun in the classroom.

Green also confirmed that the gun used in the shooting belongs to the defendant?s brother. It?s not yet known if he will face any charges, Green said, as deputies continue to investigate that aspect of the case.

She declined to provide any details about the day of the shooting, saying she didn?t want to hurt her case against Oliver, nor risk an order for a change of venue. A Monday afternoon news conference that was to have included staff and faculty who were on the scene Thursday was canceled for that reason.

Green would not confirm or deny reports that Oliver had drawn up a hit list of intended targets last year, but cited premeditation as one of the factors in the decision to charge Oliver as an adult, as well as Oliver?s age and the extent of Cleveland?s injuries.

Oliver is to be arraigned in court Monday afternoon.

Classes remained closed at the school Monday as the community of Taft took advantage of counseling that has been available on campus since last week and tried to make sense of the violence.

There were tears, hugs and prayers at a vigil Friday at A Street Park. Students and teachers repeatedly said the tragedy had brought the community closer, and vowed not to be cowed by fear.

Media from all over the world have been following the case, and the small city of about 9,464 is finding the international spotlight unnerving but doing its best to return to a normal routine, albeit with tighter security around school campuses.

Schools throughout Kern County had already been reviewing safety policies in the wake of December?s shooting at Sandy Hook Elementary School in Connecticut, in which 20 children and six adults were killed.

That incident has renewed a national debate about gun control, and Congress is sorting through various proposals ranging from banning assault rifles to regulating the sale of ammunition. Gun ownership groups oppose those efforts and are calling for armed guards on school campuses and better mental health screening.

(AP) ? At last, the storm-racked Northeast is getting a House floor vote on billions in disaster relief aid for victims of October's Superstorm Sandy, but only after a host of East Coast Republican lawmakers threatened a near mutiny against GOP Speaker John Boehner.

A $9.7 billion measure to pay flood insurance claims, which amounts to just a down payment on a multibillion-dollar aid commitment, is expected to be approved by the House on Friday, boosting prospects for relief for the many home and business owners devastated by the storm. If the House acts as expected, the Senate plans to follow with a likely uncontested vote later in the day.

The Federal Emergency Management Agency warns that the National Flood Insurance Program will run out of money next week if Congress doesn't provide additional borrowing authority to pay out claims. Congress created the FEMA-run program in 1968 because few private insurers cover flood damage.

The flood insurance measure is the first phase of a proposed Sandy aid package. Under Boehner's new schedule, the House will vote Jan. 15 on an additional $51 billion in recovery money. Senate action on that measure is expected the following week. Financially strapped local governments are awaiting that money.

Northeast lawmakers say the money is urgently needed for storm victims awaiting claim checks from the late October storm, which was one of the worst ever to strike the Northeast, ravaging the coast from North Carolina to Maine, with the most severe flooding occurring in Atlantic City, N.J., New York City and Long Island and along the Connecticut coastline.

"People are waiting to be paid," said Rep. Frank LoBiondo, R-N.J., whose district includes Atlantic City and many other coastal communities hard hit by the storm. "They're sleeping in rented rooms on cots somewhere, and they're not happy. They want to get their lives back on track, and it's cold outside. They see no prospect of relief."

The Club For Growth, a conservative group, on Friday urged lawmakers to oppose the bill, saying that Congress should only approve Sandy aid in installments to make sure the money is wisely spent and that any new Sandy aid should be offset with spending cuts elsewhere.

"Congress should not allow the federal government to be involved in the flood insurance industry in the first place, let alone expand the national flood insurance program's authority," the group said in a statement.

Boehner, of Ohio, had promised a House vote on Friday after his decision to delay an action on a broader Sandy relief package provoked outrage from Northeast Republicans, including New Jersey Gov. Chris Christie, who said he'd lost trust in GOP leaders in Congress after being promised a vote earlier this week.

About 140,000 Sandy-related flood insurance claims have been filed, FEMA officials said, and there are about 115,000 pending claims. Many flood victims have only received partial payments on their claims.

Philip Rock has received $8,000 in flood insurance payments so far but said he is awaiting a statement on the final amount, which he expects to be much more. A house he owns in Toms River, N.J., had a $220,000 flood insurance policy. The house, which he rents out, was destroyed, and he needs to know the final payout before he can demolish it.

The house is a "total loss," Rock said. "We don't want to demolish the house and have them say, 'We have to go around and take more pictures.'"

New York, New Jersey and Connecticut were the states hardest hit by the storm in terms of damage from high winds, flooding and storm surges. The storm damaged or destroyed more than 72,000 homes and businesses in New Jersey. In New York, 305,000 housing units were damaged or destroyed and more than 265,000 businesses were affected.

Speaking of the legislation pending Friday, Rep. Michael Grimm, R-N.Y., whose district includes Staten Island, said, "This funding will give the city and state the much-needed resources to rebuild our damaged infrastructure and provide further aid to individuals and small businesses struggling to pick up the pieces of their lives."

Sandy was the most costly natural disaster since Hurricane Katrina in 2005 and was blamed for at least 120 deaths. Northeast lawmakers have complained that it took just 10 days for Congress to approve about $50 billion in aid for Katrina but that it hasn't provided aid for Sandy relief in more than two months.

"States and local communities need to know the money will be there before they can give a green light to start rebuilding," said LoBiondo.

More than $2 billion in federal money has been spent so far on relief efforts for 11 states and the District of Columbia struck by the storm. New York, New Jersey, Connecticut, West Virginia, Virginia, Maryland, New Hampshire, Delaware, Rhode Island, Pennsylvania, Massachusetts and the District of Columbia are receiving FEMA aid.

HBO sued over alleged horse abuse cover-up

One of television's strangest sagas in 2012 was the March cancellation of HBO's "Luck" after the horse racing drama starring Dustin Hoffman was attacked over the treatment of animals on set.

The saga isn't quite over.

Barbara Casey, who worked as the director of production in the American Humane Association's film and television unit, has filed a lawsuit against her former employer and HBO. Casey says she worked for AHA for 13 years and is suing the organization for allegedly wrongfully terminating her in January 2012. She's also suing HBO and "Luck" producer Stewart Productions for aiding and abetting an alleged abuse cover-up months before the series was put to sleep.

According to the lawsuit filed in Los Angeles Superior Court, Casey says the AHA observed drugged horses, underweight and/or sick horses routinely used for work on the show, the misidentification of horses by producers so that animal safety reps couldn't track their medical histories and more.

Casey says HBO and Stewart Productions wanted to save time and money and that rather than cooperate with AHA, the production companies pressured the organization to allow them to violate the AHA's animal safety standards.

In a statement to The Hollywood Reporter, HBO says: "We took every precaution to ensure that our horses were treated humanely and with the utmost care, exceeding every safeguard of all protocols and guidelines required of the production. Barbara Casey was not an employee of HBO, and any questions regarding her employment should be directed to the AHA."

The AHA did not immediately respond to a request for comment.

The AHA -- which holds a trademark on the "No animals were harmed" phrase -- allegedly went along with the producers over Casey's objections and her desire to contact law enforcement authorities.

"AHA bowed to political and financial pressure and refused to report the Production Defendants' conduct to the authorities," Casey alleges in the suit. "AHA instructed Plaintiff not to report such conduct. AHA engaged in efforts to conceal and cover up the production defendants' criminal activities."

Eventually, the series was canceled after several horses died -- the complaint reports four deaths -- and after PETA spoke out in protest.

During the controversy, HBO said it had been working closely with the American Humane Association to implement safety protocols that go "above and beyond" typical film TV industry standards and practices. But Casey says that HBO didn't make the job easy for the AHA.

"The production defendants intentionally misidentified horses so that the humane officers and/or animal safety representatives could not track their medical histories," says the lawsuit.

Casey adds that after a horse named Hometrader died, the AHA actively interfered with efforts to rectify the situation. According to the complaint, "AHA told its representatives not to document (Hometrader's) death because he was killed during a summer hiatus from filming and therefore did not count."

Casey claims that it was unlawful to terminate her and retaliate against her for an attempt to report criminal activity. She is represented by attorney Howard Rutten and is seeking general and punitive damages.

Oil price jumps as US averts 'fiscal cliff'

The price of oil jumped by over a dollar on Wednesday, to above $93 a barrel, after U.S. lawmakers passed legislation to avoid a "fiscal cliff" that could have pushed the world's biggest economy into recession.

The U.S. House of Representatives voted near midnight to send the bill to President Barack Obama after a frantic day of political brinksmanship in Washington.

By early afternoon in Europe, benchmark crude for February delivery was up $1.49 to $93.31 a barrel in electronic trading on the New York Mercantile Exchange. The contract rose $1.02 to finish at $91.82 per barrel in New York on Monday.

Economists had warned that if Congress did not take action a series of tax increases and spending cuts due to automatically start this year could have helped push the U.S. into recession. They feared a spike in unemployment, which would have resulted in depressed demand for energy.

Some House Republicans at first opposed the bill, which neutralizes middle class tax increases and $24 billion in spending cuts set to take effect over the next two months while raising taxes on the wealthy. They wanted more spending cuts but hours later agreed to a simple yes-or-no vote on the bill, which had already passed the Senate.

As a result of a broad increase in market sentiment, the dollar weakened as investors felt confident to invest in relatively riskier assets. A weaker dollar makes crude cheaper and a more attractive investment for traders using other currencies. On Wednesday, the euro rose to $1.3280 from $1.3213 on Monday, the previous trading session.

Brent crude, used to price various kinds of international oil, was up $1.12 to $112.23 a barrel on the ICE Futures exchange.

In other energy futures trading on the New York Mercantile Exchange:

? Wholesale gasoline rose 3.88 cents to $2.8005 a gallon.

? Heating oil added 2.62 cents to $3.058 a gallon.

? Natural gas fell 4.1 cents to $3.31 per 1,000 cubic feet.
